To ensure clear title in real estate transactions and prevent property-related frauds, the department of registration and stamps is planning to ensure that details of the last transaction of the property are thrown up at the time of registration.

"We have started the process. When someone goes for registration (of transactions like sale and purchase, leave and license and mortgage), the previous details of the property i.e. the last transaction will pop up," Dr Ramaswami N, inspector general of registration and controller of stamps, told dna.
This is part of the process of moving to a stage where land title will be guaranteed as against today's presumptive title.
"Now, we have the e-search facility but it is cumbersome. Here, we are narrowing down the search process, which will bring down instances of frauds and eliminate duplicate (multiple) sale and mortgage with more than one party," he added.
"Discussions with the Pune and Pimpri-Chinchwad municipal corporations are on to link this to their property tax unique numbers. This will make the search and transactions easy," said Ramaswami, adding that the pilot project would be launched soon in the two cities. The plan, which was at an initial stage, would be extended to other cities like Mumbai later.
He said that linking their data with the property tax unique number would ensure that every time a transaction on a property was done, it would be identified with that number.
"This will ensure title guarantee on lines of that in other countries. However, ensuring a mechanism like the Torrens title system of land title registry (in Canada and Australia) will require digitisation of data at our end, the land records department and the city survey office. This will also have to be linked to the property tax numbers of the local bodies," said Ramaswami.
The department is also planning to ensure ease of business for corporates by providing encumbrance-free and guaranteed land titles by making available online soft copies of century-old property and land records. This will help companies and individuals to search online for the history of the land that is being bought and ensure that the property purchased by them has an assured title.
While all records since 2002 are available online, the department is digitising records from 1985 to 2002, which was the pre-computerisation stage. The documents since the 1920's which are stored in the photo registry will be digitised and put online.
